By accessing or using the Site, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site. If you are under 18 years of age, you may use the Site only with the involvement of a parent or legal guardian.

We may revise these Terms at any time by posting an updated version with a new “Last Updated” date. Changes are effective when posted, and your continued use of the Site after posting constitutes acceptance. It does not constitute a binding offer, a quote, a warranty, or a contract.

No home improvement work is sold or ordered through the Site. All pricing is subject to an in-person or otherwise documented measurement and inspection, and any project is governed exclusively by a separate written contract signed by you and the Company. In the event of any conflict between the Site and a signed contract, the signed contract controls. Product availability, manufacturer offerings, promotions, and financing terms are subject to change.

4. Guarantees and Warranties

References on the Site to our “Lifetime Guarantee,” to lifetime products, or to manufacturer warranties are summaries. The complete written guarantee governs, and its material terms include duration, what “lifetime” is measured by, transferability, exclusions, the distinction between product coverage and labor coverage, and the condition that the Company remain in business.

The complete written guarantee is available for review before you sign any contract and before any purchase. Part 702, written warranty terms for covered consumer products are made available to you prior to sale.

5. Contacting Us; Telephone, Text Message, and Chat Communications

Transactional contact. When you submit a web form, request a free quote, enter a promotion, or start a chat, you ask us to respond, and you authorize us to contact you at the email address and telephone number you provide for the purpose of responding to and servicing that specific request. You represent that the information you provide is accurate and that you are the owner or customary user of the telephone number and email address submitted.

Marketing contact requires your separate opt-in. We do not treat your submission of a telephone number, by itself, as consent to receive marketing calls or texts. Sweepstakes, contests, rebates, discounts, vouchers, travel or cruise certificates, and other promotions are governed by their own separate official rules or offer terms. If those rules conflict with these Terms, the promotion-specific rules control. No purchase is necessary to enter any sweepstakes where a sweepstakes requires no purchase by law, and no consent to marketing contact is required to enter.

Financing. We are not a lender. Financing, where offered, is provided by unaffiliated third-party lenders and is subject to their credit approval, rates, terms, fees, and disclosures.

  • Reverse engineer, decompile, or circumvent any security or access control feature of the Site;
  • Enter any promotion more times than its official rules allow, or submit entries by automated means;
  • Post or transmit content that is defamatory, harassing, obscene, infringing, or that violates the rights of any person.

8. Intellectual Property

The Site and all text, photographs, project galleries, graphics, layouts, video, logos, trade names, trade dress, and other content are owned by the Company or its licensors and are protected by United States copyright, trademark, and other laws, including the Copyright Act, 17 U.S.C. § 101 et seq., and the Lanham Act, 15 U.S.C. § 1051 et seq. Subject to these Terms, you are granted a limited, revocable, non-exclusive, non-transferable license to view and print Site content for your own personal, non-commercial evaluation of our services. All other rights are reserved. Product names, brands, and manufacturer marks appearing on the Site are the property of their respective owners and are used for identification only.

9. Copyright Complaints (DMCA)

16. Indemnification

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THE COMPANY AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS FROM AND AGAINST ANY CLAIMS, DEMANDS, LOSSES, LIABILITIES, DAMAGES, COSTS, AND EXPENSES, INCLUDING REASONABLE ATTORNEYS’ FEES, ARISING OUT OF OR RELATING TO (A) YOUR USE OF THE SITE, (B) YOUR BREACH OF THESE TERMS, (C) ANY CONTENT OR CONTACT INFORMATION YOU SUBMIT, INCLUDING ANY TELEPHONE NUMBER YOU WERE NOT AUTHORIZED TO PROVIDE, OR (D) YOUR VIOLATION OF ANY LAW OR THIRD-PARTY RIGHT.

17. Governing Law and Venue

These Terms and any dispute arising out of or relating to them or to the Site are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules, and by applicable United States federal law. You and the Company consent to the exclusive jurisdiction and venue of the state courts located in Macomb County, Michigan, and the United States District Court for the Eastern District of Michigan, and waive any objection based on inconvenient forum. Nothing in this Section limits your right to file a complaint with any government agency.

18. Dispute Resolution; Informal Resolution First

Before filing any claim, you agree to notify us in writing at the address in Section 21 and give us thirty (30) days to attempt to resolve the matter informally. Except for claims that may be brought in small claims court and claims for injunctive relief to protect intellectual property, the parties will first attempt to resolve any dispute through good-faith negotiation and, if unresolved, may agree in writing to mediation in Macomb County, Michigan, with fees shared equally. Each party waives any right to bring or participate in a class, collective, or representative action arising out of use of the Site, to the extent permitted by law.

19. Electronic Communications and Signatures

You consent to receive communications from us electronically, including by email and text message, and agree that electronic records and signatures, including a checkbox you affirmatively select, satisfy any legal requirement that communications or consents be in writing and signed, consistent with the federal E-SIGN Act, 15 U.S.C. § 7001 et seq., and the Michigan Uniform Electronic Transactions Act, MCL 450.831 et seq.

20. Termination, Severability, and Miscellaneous

We may suspend or terminate your access to the Site at any time, for any reason, without notice. If any provision of these Terms is held unenforceable, that provision will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and any promotion-specific official rules, constitute the entire agreement between you and the Company regarding the Site. Sections 3, 4, 5, 6, 8, 10, and 14 through 18 survive termination. Headings are for convenience only.
